PhotoFax, Inc (hereinafter “PhotoFax”) has established this privacy and data security policy to explain to you how private information (hereinafter “Client Data”) that you place on the site is protected, collected, and used. PhotoFax may update this policy at any time provided that you are given notice prior to any changes going into effect unless such changes are required to comply with federal or state law, in which case such changes will become effective immediately upon notification thereof.

This Privacy Policy applies to PhotoFax.com (Marketing Website).

Data PhotoFax Collects About Its Users.

PhotoFax collects the following information: correspondence through PhotoFax’s website, and correspondence sent to PhotoFax; additional information PhotoFax may ask you to submit including, but not limited to, information to authenticate yourself, information to prove that you are able to enter into a legally binding contract, or information if PhotoFax believes you are violating its policies; and, other supplemental information from third parties (hereinafter “Personal Data”).

PhotoFax sometimes collects your name email address, for purposes of sending information about PhotoFax and its Marketing Website. By submitting your email to PhotoFax, you consent to emails from PhotoFax.

PhotoFax sometimes collects your phone number for the purpose of contacting you regarding the services PhotoFax provides. By submitting your phone number to PhotoFax, you consent to phone calls from PhotoFax, even if such number is registered through a state or federal “Do Not Call” list.

PhotoFax may collect Personal Data if you provide it in feedback or comments or if you contact PhotoFax directly.

Any information posted on the public areas of the website is not confidential. Please do not post anything on the public areas of the website that you would like to keep private.

PhotoFax’s web logs collect standard web log entries for each page served, including your IP address, page URL, and timestamp. Web logs help PhotoFax diagnose technical problems, administer the PhotoFax Marketing Website, and otherwise provide PhotoFax’s service to you.

PhotoFax does not do any geolocation tracking directly through the Marketing Website.

Protecting Your Personal Data

PhotoFax makes all attempts to protect your private information. PhotoFax makes your Personal Data available to PhotoFax staff members and designated subcontractors specifically to assist you with the services to which you have subscribed.

PhotoFax, or people who upload data to PhotoFax, may provide links or interfaces with third party websites, which may have different privacy practices. PhotoFax is not responsible for, and does not have any control over, the privacy policies of those third party websites, and encourages all users to read the privacy policies of each website visited.

PhotoFax does not sell Personal Data or Client Data to third parties under any circumstance, including but not limited to advertising, data farming, and external research.

Data Privacy and Ownership

PhotoFax’s policy is that each client’s Client Data, belong to that client and that client only. PhotoFax does not obtain ownership of a client’s Client Data after it has been uploaded into the system.

PhotoFax only retains ownership of its proprietary system, including its features, tools, designs, schematics, functionality, patents, trademarks, copyrights, and other intellectual material that is not dependent on any individual client’s Client Data. Authorized PhotoFax staff members access Client Data as necessary to provide client support, and PhotoFax provides some specific features where it acts as a facilitator of data transfers on behalf of a client, but it does these only with the permission of the client.

Archiving and Display of PhotoFax’s Website by Search Engines and Other Websites

Search engines and other websites not affiliated with PhotoFax – including Google.com and Yahoo.com – archive or otherwise make available PhotoFax’s main public-facing corporate pages. PhotoFax has no control over third party archiving and search engine websites and cannot guarantee the accuracy of any information stored by these websites.

Circumstances under Which PhotoFax may Share Information

PhotoFax may disclose Personal Data and/or Client Data if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal processes.

PhotoFax may disclose Personal Data to law enforcement officers or others, in the good faith belief that such disclosure is reasonably necessary to: enforce PhotoFax’s Terms of Use; respond to claims that any posting or other content violates the rights of third-parties; or protect the rights, property, or personal safety of PhotoFax, its users, or the general public.

PhotoFax may disclose Personal Data and/or Client Data from your account to a third party if you request it in writing.

PhotoFax may disclose your Personal Data and/or Client Data to third parties for use by PhotoFax to help provide the services to you if allowed under federal, state and local laws.

PhotoFax may disclose your Personal Data to other business entities, should PhotoFax plan to merge with or be acquired by that business entity. Client Data will only be transferred if a merger or acquisition actually takes place.

PhotoFax will never use or share Personal Data we have collected for reasons unrelated to the ones described above without providing an opportunity to opt-out or prohibit unrelated sharing.
